These terms apply between you as guest and ZiaNeo Systems UG (haftungsbeschränkt), registered office as stated in the imprint, legally represented by Tatiana Schöneberger („MOLOFY", „we").
Use and account: To make a booking you must be at least 18 years old and have full legal capacity. Your details (name, contact information) must be truthful and up to date. If you use an account, keep your credentials confidential and notify us without delay if you suspect misuse.
MOLOFY operates at molofy.com a marketplace for maritime experiences where vetted boat providers (hereafter „skippers") publish their tours and experiences. We provide a pure intermediary/brokerage service aimed at concluding contracts for the use of vessels between you and the skipper — comparable to a booking platform, not to a tour operator within the meaning of Directive (EU) 2015/2302 on package travel.
MOLOFY is not your contracting party for the tour, does not operate any boat and carries no tour-operator responsibility. This role lies with the skipper (see § 3).
Vetting is not a guarantee: Before onboarding, MOLOFY vets providers (identity, insurance, licences). This vetting is carried out diligently but does not constitute a guarantee for the performance, quality or continued fulfilment of these requirements by individual skippers. The activity at sea is the skipper's sole responsibility.
All providers on MOLOFY are traders within the meaning of § 14 German Civil Code (BGB); the verification prior to activation includes trader status. Your statutory consumer rights vis-à-vis the provider therefore remain fully intact. The obligations under the experience contract (performance, safety, warranty) rest with the provider; MOLOFY owes the intermediation and platform service under these terms.
Ranking: The order in which experiences are displayed is determined primarily by the match with your search (region, date, category, number of persons), availability on the selected date, reviews and the provider's quality score, as well as how up to date and complete the listing is. Providers can additionally book paid highlighting; such placements are labelled as highlighted in the display and do not alter the reviews.
The actual charter or experience contract comes into force directly between you and the skipper as soon as your booking is confirmed. The skipper is responsible towards you for proper performance of the tour, for valid boating licences and permits as required by the applicable national maritime regulations of the port of departure, for mandatory third-party liability insurance and for safety on board. Claims arising from the tour itself must be addressed to the skipper — contact details are provided in the booking confirmation.
The customer price you see on MOLOFY is split into two payments:
The deposit is 20 % of the customer price, rounded up to the next 5 €. Example: for a customer price of 350 € you pay 70 € online by card and 280 € at the boat. For a customer price of 342 € the deposit would be 70 € (68.40 € rounded up) online and 272 € at the boat. The exact amounts are shown both in the booking wizard prior to confirmation and in the booking confirmation you receive immediately after payment.
Immediately after booking we send you a booking confirmation by e-mail containing all key data (experience, date, booking number, total price, deposit, balance). For private travel this confirmation is usually sufficient as proof.
Should you additionally require a VAT invoice for the booking fee, you can request one at any time in the booking portal („Request invoice" button). The invoice is automatically generated as a PDF with your details and the invoicing party's tax data.
An invoice for the charter portion (payment at the boat) is issued to you by the skipper upon request. Please ask the skipper directly on site or by message. Some skippers also offer a combined total invoice — ask them if you intend to use the trip for business purposes.
Selecting an experience, date and number of persons in the booking wizard is non-binding. The booking becomes binding only upon successful payment of the deposit. From that moment you receive a booking confirmation, the skipper is informed and your slot is secured.
With instant booking, the reservation is confirmed immediately. In exceptional cases (e.g. requests with special requirements) it may remain subject to skipper approval — this is then stated in your confirmation.
If you cancel your booking, the deposit already paid (= booking fee) is forfeited. This is standard practice in boat charter because the slot was reserved for you and blocked for other guests. The skipper cannot refund the deposit because they never received it.
Cancellations less than 24 hours before the tour must be handled exclusively via the skipper (phone/WhatsApp from the booking confirmation).
Important note on weather: Unfavourable but normal weather conditions (wind, swell, cloud cover, rain) do not entitle you to a free cancellation as long as there is no official weather or sea warning or official navigation ban for the tour period and the skipper carries out the tour. Whether the tour can be carried out safely is decided solely by the skipper in their responsibility as the vessel's master (§ 7.3).
You can submit rescheduling requests in the booking portal — the skipper will review and confirm. Rescheduling is free of charge if the skipper approves and the new date falls within the current season.
If the skipper cancels for compelling reasons — in particular an official weather or sea warning or an official navigation ban for the tour period, a technical problem with the boat or a specific safety hazard — you receive a full refund of the deposit. The refund is processed automatically via Stripe back to the payment method you used for the deposit, within a few working days.
If you fail to appear at the boat without prior cancellation, the deposit is forfeited. The skipper may additionally pursue the outstanding balance under civil law — MOLOFY is not involved in such a claim.
Weather, safety and force majeure: If the skipper has to cancel the tour for compelling reasons — in particular weather or sea warnings, a technical fault on the boat or an official navigation ban — you are entitled to a free rebooking within 12 months or to a full refund of the deposit. The same applies if participation becomes verifiably impossible for you due to extraordinary, unforeseeable circumstances beyond your control (e.g. official travel restrictions). Statutory rights going beyond this remain unaffected.
Via the boat pool you can ask MOLOFY to search for a boat trip on your behalf. You state up to four preferred days (within seven days), your group size, pets if any, your maximum budget per person and your preferred starting port, and you pay an advance payment per person in the amount shown at sign-up (adults and children count the same; pets are free). The advance payment is a prepayment towards the trip price and is fully credited if a trip comes about — on board you only pay the remainder. Deviating from section 4, the advance payment in the pool follows the per-person flat amount shown and the top-up under paragraph 2.
How the booking comes about: Your search order is at the same time a binding contractual offer to all operators matching your criteria — in particular available on one of your preferred days and not exceeding your maximum budget. The first operator who accepts this offer on your criteria concludes the contract; a separate confirmation by you is then no longer required. Upon acceptance the remaining advance payment is collected via the payment method used at sign-up — at most 20 % of your stated maximum budget; we show you the concrete maximum amount in euros before you place the order. You expressly consent to this follow-up charge when placing the order; every amount collected is fully credited towards the trip price. If the charge fails or no payment was made at sign-up, you receive a payment link with a reasonable deadline. The booking only becomes effective upon full payment of the advance; otherwise the acceptance lapses and any amounts already paid are refunded to you in full. Once concluded you immediately receive the booking confirmation with day, experience, price, meeting point and time; from then on the remaining rules of these terms apply.
Refund and remuneration: If no operator accepts your offer by the end of your last preferred day, the advance payment is refunded automatically and in full — in that case we mediated nothing and earn nothing. If a trip comes about and you subsequently cancel it yourself, the cancellation rules of section 7 apply: the advance payment is not refunded because our search and mediation service is fully rendered — and thus earned — with the concluded booking. The right to prove lower damages under section 7.1 applies accordingly. You can raise objections at any time via info@molofy.com; we review every individual case.
Right of withdrawal for the search order: The search order is a service. When placing the order you expressly request that we start searching immediately and you confirm your knowledge that your right of withdrawal expires once we have fully rendered the service — which is the case as soon as an operator has accepted your offer and the booking has come about (§ 356(4) German Civil Code). Before that moment you may withdraw your search order at any time; details are in our withdrawal policy.
If an operator cannot carry out a trip already promised — for instance due to overbooking, illness or a defect — he may, with your consent, hand your request over to MOLOFY so that we can find you another boat. The handing-over operator is responsible for transferring your contact details; we inform you immediately upon receipt that we are searching for you. If you do not want this, a message to info@molofy.com is enough and we delete the request.
You pay nothing for this request at hand-over. If an operator accepts it, you receive a payment link from us; only there do you conclude the contract. Before you submit we show you the trip, day, total price, the amount payable online and the remainder on board, and we obtain your consent to these terms as well as the declaration under § 356(4) German Civil Code. If you do not pay within the stated period, the acceptance lapses; this causes you no costs. If nobody accepts by the last preferred day, we inform you and the handing-over operator — this too is free of charge for you.
For the successful mediation the accepting operator owes us our remuneration; we remunerate the handing-over operator separately for the referral. Both amounts are remunerations in the relationship between MOLOFY and the operators and do not affect your price.
Your booked tour is provided on a specific date or period of performance; it therefore falls within the exceptions to the 14-day statutory right of withdrawal. The following legal bases apply cumulatively:
This applies both to the tour you booked and to MOLOFY's booking service, which has already been performed with your payment. Cancellation remains possible under the rules in § 7 above; a 14-day right of withdrawal does not exist.
MOLOFY's intermediation service: To the extent that a right of withdrawal may apply to the intermediation and booking service itself, § 356 (4) German Civil Code (BGB) applies in addition: during the booking process you expressly consent to MOLOFY beginning the intermediation service immediately and performing it in full upon confirmation of your booking, and you confirm your knowledge that the right of withdrawal expires upon full performance of the contract.
Instructions of the skipper are binding during the tour. Boating licences or local safety regulations (e.g. life jackets, no-smoking areas, alcoholic beverages) are communicated by the skipper. In case of serious non-compliance the skipper may terminate the tour — no refund arises in that case.
Booking for others and minors: If you book for fellow travellers, you warrant that all participants meet the tour-relevant requirements (swimming ability, physical fitness, no acute health risk). You must inform the skipper of any health limitations (e.g. pregnancy, restricted mobility) and the participation of children before departure. Persons under 18 may only participate accompanied by an adult with parental responsibility and remain under their supervision.
After the tour you receive a magic link to review the skipper. Reviews are only possible after verified bookings. Please stay factual and fair — our skippers depend on honest feedback.
Authenticity of reviews (§ 5b (3) German Act against Unfair Competition (UWG)): We ensure the authenticity of MOLOFY reviews by sending the review link exclusively to guests with a completed, paid booking; reviews without a verified booking are technically impossible. We do not allow paid or otherwise incentivised reviews and remove them. Where we additionally display reviews from a provider's Google profile, these are labelled as Google reviews; their authenticity is verified by Google, not by MOLOFY.
MOLOFY is liable exclusively for the proper provision of intermediation and platform services. For damages arising from the tour itself (injury, property damage, luggage, delay), the skipper is liable under statutory provisions. We recommend private travel and accident insurance if you value additional coverage.
For intentional or seriously negligent breaches of duty on our part, we are liable under statutory provisions. Otherwise our liability is limited to the foreseeable damage typical of the contract.
Scope of platform vetting: The vetting of providers (identity, insurance and licence documentation, Q-Score) is a duty-of-care measure, not a promise of success. An activation does not create a warranty by MOLOFY for the skipper’s service itself.
Platform availability: We aim for uninterrupted operation but cannot guarantee continuous availability of molofy.com. Maintenance, security updates and outages may cause temporary limitations; already confirmed bookings are not affected.
Measures on breach and complaint: In case of violations of these terms or applicable law we may remove content, cancel bookings or limit or suspend your account. You will receive notice with reasons. You can lodge a complaint within 30 days by email to info@molofy.com; we will review and respond within a reasonable period. Your rights under the EU Digital Services Act (in particular complaints to competent authorities and out-of-court dispute settlement under Art. 21 DSA) remain unaffected.
We process your data solely for booking handling, communication with the skipper and statutory retention. Details in our Privacy Policy. We pass your contact details to the skipper so they can arrange the tour with you.
Material amendments will be announced by e-mail to the address you provided at booking. For bookings already made, the terms in force at the time of booking apply.
Changes to the service: For objective reasons (further development, security, legal requirements) we may modify, add or discontinue platform features. Core functions for already booked services are not affected.
Skippers enter their experience descriptions in their own language. Titles, subtitles, descriptions, time information, location and meeting-point details are displayed on molofy.com automatically translated into German, English, Italian, Spanish and French with the help of artificial intelligence, so that you can read the listing in your language. Translations may deviate from the original; the description in the source language entered by the provider is authoritative for the service. You can switch to another language at any time via the language switcher at the top of the page. Legal texts (terms and conditions, privacy policy, imprint) are binding in German.
In accordance with Art. 50 of EU Regulation 2024/1689 on artificial intelligence (AI Act) we label automatically translated texts on the respective listing with the note "Automatically translated from <language>". Images that providers have created with generative AI are marked on the listing with a visible "AI-generated" badge. The statutory labelling obligation for AI images rests with the respective provider who uploads the image; MOLOFY provides the technical means for this and makes the label publicly visible.
These terms are governed by German law. If you are a consumer resident in the EU, pursuant to Article 6 of Regulation (EC) No 593/2008 (Rome I), you retain in any case the mandatory consumer-protection provisions of your country of habitual residence. Under Article 18 of Regulation (EU) No 1215/2012 (Brussels I recast), as a consumer you may sue MOLOFY either at our registered office (see imprint) or at the courts of your place of domicile.
The former EU online dispute resolution platform under Regulation (EU) 524/2013 was discontinued on 20 July 2025 by Regulation (EU) 2024/3228. We are not obliged and not willing to participate in dispute-resolution procedures before a consumer arbitration board under § 36 VSBG (German Consumer Dispute Resolution Act); we review individual cases voluntarily.
Assignment of the contract: You may only transfer your rights and obligations under this contract to third parties with our consent. MOLOFY may transfer the contract as part of a restructuring, business transfer or to an affiliated entity with 30 days’ notice; you may then terminate the contract without notice.
Should individual provisions be invalid, the validity of the remainder shall be unaffected. The invalid provision shall be replaced by the statutory rule.
